이용약관

제1조 (목적)

이 약관은 Gallery(이하 "서비스")의 이용 조건과, 서비스 운영자(이하 "운영자")와 이용자 간의 권리·의무·책임 사항을 규정함을 목적으로 합니다.

제2조 (용어의 정의)

• "이용자"란 서비스에 접속하여 이 약관에 따라 서비스를 이용하는 자를 말합니다.
• "갤러리 소유자"란 갤러리 개설을 신청하고 운영자의 승인을 받은 이용자를 말합니다.
• "콘텐츠"란 이용자가 서비스에 업로드하거나 게시한 사진, 동영상, 텍스트 등 일체를 말합니다.

제3조 (서비스의 내용)

• 공개 갤러리의 열람
• Discord 계정을 이용한 로그인
• 갤러리 개설 신청 및 승인된 갤러리의 미디어 업로드·관리
• 새 콘텐츠에 대한 Discord DM 알림

제4조 (계정)

이용자는 Discord 계정으로 인증하여 서비스를 이용합니다. 계정의 관리 책임은 이용자에게 있으며, 계정의 부정 사용으로 발생하는 문제에 대한 책임은 이용자에게 있습니다.

제5조 (이용자 콘텐츠의 권리와 책임)

1. 콘텐츠에 대한 저작권 등 지식재산권은 이를 업로드한 이용자(원작자)에게 있습니다.
2. 운영자는 콘텐츠의 저장 공간과 전송 수단을 제공할 뿐이며, 콘텐츠의 저작권·초상권 등 권리의 확보 여부와 권리 침해 분쟁에 대한 책임은 전적으로 해당 콘텐츠를 업로드한 이용자에게 있습니다.
3. 이용자는 업로드하는 콘텐츠에 대해 저작권·초상권 등 필요한 권리를 확보하였음을 보증하며, 콘텐츠로 인해 발생하는 분쟁과 손해에 대해 운영자를 면책합니다.
4. 운영자는 이 약관 또는 법령에 위반된다고 판단되는 콘텐츠를 사전 통지 없이 삭제하거나 공개를 제한할 수 있습니다.

제6조 (금지 콘텐츠)

이용자는 다음에 해당하는 콘텐츠를 업로드하거나 게시할 수 없습니다.

• 음란물 등 성적으로 노골적인 콘텐츠
• 아동·청소년을 성적 대상으로 하는 모든 콘텐츠 (어떠한 예외도 없이 금지)
• 과도하게 폭력적·잔인하거나 특정 집단에 대한 혐오를 조장하는 콘텐츠
• 법령에 위반되거나 범죄를 조장하는 콘텐츠
• 타인의 저작권·초상권·명예·사생활 등 권리를 침해하는 콘텐츠
• 악성코드, 스팸, 광고성 콘텐츠

위반 시 운영자는 콘텐츠 삭제, 갤러리 이용 제한 등 필요한 조치를 할 수 있습니다.

제7조 (권리 침해 신고)

1. 누구든지 서비스 내 콘텐츠가 자신의 저작권·초상권 등 권리를 침해한다고 판단하는 경우, 사이트 내 신고 폼 또는 Discord 알림 계정 DM으로 운영자에게 신고할 수 있습니다.
2. 신고에는 침해라고 주장하는 콘텐츠의 위치(URL), 침해 사유, 신고인의 연락처를 포함해야 합니다.
3. 운영자는 신고를 접수한 뒤 지체 없이 검토하고, 권리 침해가 명백하거나 소명이 충분한 경우 해당 콘텐츠의 삭제 또는 공개 제한 등 필요한 조치를 합니다.
4. 허위 신고로 인해 발생하는 책임은 신고인에게 있습니다.

제8조 (서비스의 변경 및 중단)

서비스는 1인이 운영하는 개인 서비스로, 안정적인 제공을 보장하지 않습니다. 운영자는 사이트 공지를 통해 서비스의 전부 또는 일부를 변경하거나 중단할 수 있으며, 이로 인해 발생하는 손해에 대해 책임지지 않습니다.

제9조 (면책)

1. 운영자는 천재지변, 불가항력, 이용자의 귀책 사유로 인한 서비스 장애에 대해 책임지지 않습니다.
2. 운영자는 이용자가 게시한 콘텐츠의 신뢰도와 정확성을 보증하지 않습니다.
3. 운영자는 이용자 간 또는 이용자와 제3자 간에 콘텐츠를 매개로 발생한 분쟁에 개입할 의무가 없으며, 이로 인한 손해를 배상할 책임이 없습니다.

제10조 (약관의 변경)

운영자가 이 약관을 변경하는 경우 시행 7일 전에 사이트에 공지합니다. 변경된 약관의 시행일 이후에도 서비스를 계속 이용하는 경우 변경에 동의한 것으로 봅니다.

제11조 (준거법)

이 약관은 대한민국 법령에 따라 해석되고 적용됩니다.

Article 1 (Purpose)

These Terms govern the use of Gallery (the "Service") and set out the rights, obligations, and responsibilities of the Service operator (the "Operator") and its users.

Article 2 (Definitions)

• "User" means anyone who accesses and uses the Service under these Terms.
• "Gallery Owner" means a User whose gallery application has been approved by the Operator.
• "Content" means photos, videos, text, and anything else a User uploads or posts to the Service.

Article 3 (The Service)

• Browsing of public galleries
• Sign-in with a Discord account
• Gallery applications and, once approved, media upload and management
• Discord DM notifications about new content

Article 4 (Accounts)

Users sign in with their Discord account. Users are responsible for managing their accounts and for any issues arising from unauthorized use of them.

Article 5 (Rights and Responsibility for User Content)

1. Copyright and other intellectual property rights in Content belong to the User who uploaded it (the original creator).
2. The Operator merely provides storage and delivery for Content. Responsibility for securing rights — including copyright and portrait rights — and for any infringement dispute lies entirely with the User who uploaded the Content.
3. Users represent that they hold all rights necessary for the Content they upload, and shall hold the Operator harmless from any dispute or damage arising from their Content.
4. The Operator may remove or restrict Content that it determines violates these Terms or applicable law, without prior notice.

Article 6 (Prohibited Content)

Users may not upload or post Content that:

• is sexually explicit or pornographic;
• sexually depicts or targets children or minors in any way (no exceptions);
• is excessively violent or gory, or incites hatred against any group;
• violates the law or promotes criminal activity;
• infringes others' copyright, portrait rights, reputation, or privacy;
• contains malware, spam, or advertising.

Violations may result in removal of the Content and restriction of gallery use.

Article 7 (Reporting Rights Infringement)

1. Anyone who believes Content on the Service infringes their copyright, portrait rights, or other rights may report it to the Operator via the report form on the site or by DM to the Service's Discord notification account.
2. A report must include the location (URL) of the allegedly infringing Content, the grounds for the claim, and the reporter's contact information.
3. Upon receiving a report, the Operator will review it without delay and, where infringement is clear or sufficiently substantiated, take necessary action such as removing the Content or restricting its visibility.
4. Reporters are responsible for any consequences of false reports.

Article 8 (Changes and Suspension)

The Service is a personal project run by one person and is not guaranteed to be stable. The Operator may change or suspend all or part of the Service with notice posted on the site, and is not liable for any resulting damage.

Article 9 (Disclaimers)

1. The Operator is not liable for service failures caused by natural disasters, force majeure, or the User's own fault.
2. The Operator does not guarantee the reliability or accuracy of User-posted Content.
3. The Operator has no obligation to intervene in disputes between Users, or between Users and third parties, arising from Content, and is not liable for damages from them.

Article 10 (Changes to These Terms)

Changes will be announced on the site at least 7 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the changes.

Article 11 (Governing Law)

These Terms are governed by and construed under the laws of the Republic of Korea.
